Terms of Service
1. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the authority to enter into these Terms on behalf of yourself or any organisation you represent.
2. Account Registration
To access the Service, you must create an account and provide accurate, complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activities that occur under your account.
- Promptly notifying us of any unauthorised access to your account at legal@similarfy.com.
We reserve the right to suspend or terminate accounts that violate these Terms.
3. Permitted Use
You may use the Service only for lawful purposes, including but not limited to:
- Checking your own academic or professional documents for originality.
- Institutional verification of student submissions as an authorised faculty member or administrator.
- Research integrity validation in an academic or professional context.
4. Prohibited Use
You must not use the Service to:
- Upload documents that contain personally identifiable information of third parties without their consent.
- Infringe the intellectual property rights of others.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Transmit malware, viruses, or any malicious code.
- Use automated scripts, bots, or scrapers to access the Service.
- Circumvent any authentication or access control measures.
- Resell, sublicense, or commercialise the Service or reports without our written permission.
- Use reports generated by the Service as the sole basis for legal, disciplinary, or criminal proceedings without independent verification.
5. Pricing Plans and Payments
- The Service operates on a pre-purchase pricing plan model. One (1) check = one (1) document analysis.
- Purchased checks/credits are valid for 30 days only from purchase and are non-transferable between accounts.
- All purchases are final. Refunds are not available for used checks.
- Unused checks may be refunded at our discretion within 14 days of purchase, subject to a written request.
- Prices are displayed in Sri Lankan Rupees (LKR) and are subject to change without notice. Price changes will not affect already-purchased pricing plans.
- We reserve the right to correct pricing errors, including after a purchase has been made.
6. Intellectual Property
All content, software, algorithms, trademarks, logos, and features of the Service are the intellectual property of Similarfy.com or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service as outlined in these Terms.
You retain all ownership rights in the documents you upload. By uploading documents, you grant us a limited, temporary licence to process them solely to generate your requested report.
7. Report Accuracy and Limitations
Plagiarism and AI-detection reports are provided for informational purposes only. While we strive for the highest possible accuracy, no detection system is infallible. You acknowledge that:
- Reports may contain false positives or false negatives.
- Reports should not be used as the sole basis for academic disciplinary action.
- Human review and professional judgment remain essential in interpreting results.
- Similarfy.com is not liable for decisions made based on report outputs.
8. Service Availability
We aim to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance, updates, or unforeseen outages may temporarily affect availability. We will provide advance notice of planned downtime where possible.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Your use of the Service is at your sole risk.
10. Limitation of Liability
To the fullest extent permitted by applicable law, Similarfy.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, including but not limited to loss of data, loss of revenue, or reputational harm, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from or relating to the Service shall not exceed the amount you paid to us in the 90 days preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Similarfy.com and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Unused checks are non-refundable upon voluntary account termination.
13. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of Sri Lanka. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
14. Changes to These Terms
We may modify these Terms at any time. When we make material changes, we will notify you by email or through a prominent notice on the platform at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
